These General Conditions of Use must be read completely and carefully.

​1. ACCEPTANCE OF TERMS
These General Conditions of Use (the "Conditions") govern the rights, obligations and restrictions related to the use of the Elixeer website accessible via the url (hereinafter the "Site") by the user ("the 'User'). The Site is published by ELIXEER.
​Use of the Content (as defined below) is subject to acceptance of the Terms which automatically apply to any use of the Site.
IF YOU DO NOT AGREE TO THE TERMS OF USE MENTIONED BELOW, PLEASE DO NOT USE THE SITE.
Using all or part of the Content implies that you accept and undertake to comply with these Conditions without reservation. The Content includes in particular (i) any intellectual property right (including but not limited to trademarks, designs and models, domain names, logos, copyright relating to the products displayed, (ii) any textual element , graphic, video, visual or sound appearing on the Site. Under Article 6 below, Elixeer reserves the right, at any time, to modify the stipulations of the Conditions, whether by making additions or deletions.

​2. CONDITIONS OF ACCESS TO THE SITE
The Site is accessible to everyone.
Access to the Site is from a computer connected to a telecommunications network according to the communication protocols used on the Internet network.
The User is informed that the Site is optimized to be viewed from smartphones and tablets. The User must have his own compatible means of telecommunication and Internet access.
The User is also informed that the cost of accessing and browsing the Site is his sole responsibility.

3. INTELLECTUAL PROPERTY RIGHTS
All Content, and all intellectual property rights related to their design, the selection of these elements, their presentation and their organization belong to Elixeer, the Elixeer group or their assigns. Similarly, the trademarks (including the "Dreamquest" trademark), domain names, acronyms, logos, designs and others that appear on the Site are the exclusive property of Elixeer or their partners who have granted them a license for use in the framework of the Site. All Content is protected by copyright, legislation on databases, designs and models, trademarks, and more generally, international conventions and other laws protecting intellectual property and related exclusive rights. Any reproduction or representation of these elements or of all or part of the Content in any way and for any reason whatsoever is prohibited without the prior authorization of Elixeer and, where applicable, the licensors and assigns. The User acknowledges that he is only authorized to use these elements and information appearing on the Site within the limits expressly set by Elixeer. He further acknowledges and agrees that none of these Terms shall have the effect of transferring to him ownership of any trademark, trade name or other proprietary right in any part of the Content. He undertakes not to do anything that is in contradiction with this article or that is likely to prejudice, in any way whatsoever, Elixeer, their successors or assigns, in this respect.

4. ADVERTISING AND PROMOTING PRODUCTS
Within the Site, Elixeer may highlight, at its sole discretion, certain products by inserting promotional links, advertising banners, windows, called “pop-ups” when opening the Site. It is understood that Elixeer may carry out cross-marketing operations with any partner of its choice.

5. LIABILITY, WARRANTY AND INDEMNIFICATION
Although Elixeer makes every effort to ensure the permanent availability of the servers, access to the Site may be temporarily suspended for technical or maintenance reasons, without prior warning. Browsing on the Site is at the User's own risk. Elixeer is not responsible for the permanent updating of the Site. Elixeer does not warrant that the Site is free of viruses and other harmful components. It is up to the User to take all appropriate measures to protect their own data and/or software from contamination by any viruses circulating on the Internet.
The User accepts the fact that Elixeer and its service providers cannot under any circumstances be held liable for incidental, material and/or immaterial, direct and/or indirect damage that may result from access to or use of the Site, including inaccessibility, loss of data, damage, destruction or viruses that could affect the User's computer equipment, and/or the presence of viruses on its Site.
Furthermore, any material downloaded and/or obtained, in any way whatsoever, during the use of the Site, is at the sole risk of the User. Elixeer will not be liable for any damage and/or loss of data suffered by the User.

6. UPDATE OF SERVICES AND MODIFICATION OF CONDITIONS
Elixeer reserves the right to modify these conditions of use of the Site (including, for example, by changing the conditions of access to the Site or by adding collaborative spaces) without notice or prior information to the User.

7. TITLES AND HEADINGS.
The title of the clauses has the sole purpose of facilitating the reading and understanding of these Conditions and can in no way prejudge the content of the clauses and the interpretation that may be made of them.

8. LAW AND JURISDICTION
These Conditions are governed by French law, without application of its rules relating to conflict of laws; and each User expressly acknowledges the exclusive jurisdiction of the French Courts for any complaint or dispute with Elixeer, or in any way related to the use of the Site, and each User further agrees to the exercise of territorial jurisdiction in the French Courts in connection with any such dispute.

9. FORCE MAJOR
Subject to the applicable legal provisions, Elixeer cannot be held liable for a fortuitous event, force majeure as defined by case law and the French Civil Code.
